Bay Harbor Beauty Affiliate Program Terms

Welcome to the Bay Harbor Beauty Affiliate Program. By signing up as an affiliate, you ("Affiliate," "you") agree to these terms with Bay Harbor Beauty ("we," "us," "our"). Please read carefully.

1. Eligibility You must be at least 18 years old and able to enter a legally binding agreement. You're responsible for the accuracy of the information you provide when registering.

2. Commission You will earn a 15% commission on the net product subtotal of qualifying sales made through your unique affiliate link or coupon code. Commission is calculated on the product subtotal only and excludes shipping, taxes, gift cards, and any discounts applied to the order.

3. Tracking & Attribution Sales are tracked using a 7-day cookie window from the time a customer clicks your affiliate link, or by use of your assigned coupon code at checkout. We rely on our affiliate platform (GoAffPro) for tracking and reserve final authority on attribution disputes.

4. Payouts Commissions are paid out on our regular payout schedule once verified. You're responsible for setting up your preferred payout method (e.g., PayPal) inside your affiliate dashboard. Minimum payout thresholds, if any, are shown in your dashboard.

5. Refunds, Returns, and Chargebacks If a referred order is refunded, returned, canceled, or charged back, the associated commission will be reversed or deducted from future payouts.

6. FTC Disclosure Requirement You agree to comply with all applicable U.S. Federal Trade Commission (FTC) guidelines for endorsements and testimonials. Specifically, you must clearly and conspicuously disclose your affiliate relationship with Bay Harbor Beauty on every promotional post, story, video, email, blog, or other content. Acceptable disclosures include "#ad," "#affiliate," "paid partnership," or similar plain-language disclosures placed where they are visible without clicking "more" or scrolling.

7. Promotional Conduct You agree NOT to:

• Send unsolicited email, SMS, or messages (spam) promoting Bay Harbor Beauty.
• Bid on "Bay Harbor Beauty," variations, or our branded terms in paid search engines (Google Ads, Bing Ads, etc.).
• Use misleading, false, or deceptive claims about our products.
• Make medical, therapeutic, drug-like, or "cure" claims about any product.
• Use our logos, product images, or content other than those we've authorized or that appear in your affiliate dashboard's marketing assets.
• Register domains or social handles that include "Bay Harbor Beauty" or confusingly similar names.
• Engage in self-referrals or fraudulent transactions.

8. Intellectual Property We grant you a limited, non-exclusive, revocable license to use our brand assets (logos, product photos, approved copy) solely to promote Bay Harbor Beauty products during the term of this agreement. All rights revert to us upon termination.

9. Independent Contractor You are an independent contractor, not an employee, agent, or representative of Bay Harbor Beauty. You have no authority to bind us, accept payment on our behalf, or make representations beyond approved marketing content.

10. Taxes You are solely responsible for reporting and paying any taxes on commissions earned. If you are a U.S. person and earn $600 or more in a calendar year, we will request a completed IRS Form W-9 and will issue a Form 1099-NEC at year end.

11. Privacy Information you provide during signup and program participation is handled in accordance with our Privacy Policy at bayharborbeauty.com/policies/privacy-policy.

12. Termination Either party may terminate this agreement at any time, for any reason, with or without notice. Upon termination, your affiliate link/code will be deactivated. Unpaid earned commissions on verified sales will be paid out according to the normal schedule, subject to any reversals.

13. Changes to These Terms We may update these terms from time to time. Material changes will be communicated by email or via the affiliate dashboard. Continued participation in the program after updates constitutes acceptance of the new terms.

14. Limitation of Liability To the maximum extent permitted by law, Bay Harbor Beauty is not liable for any indirect, incidental, special, or consequential damages arising from your participation in the affiliate program. Our total liability is limited to the amount of commissions owed to you.

15. Governing Law These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.
